What each side is responsible for
Fowlguard supplies the software and operates the platform it depends on. Your organisation decides how it is configured, who may use it, and what its policies permit. Those are different responsibilities and the product keeps them apart.
Your licence
A subscription grants your organisation the right to use Fowlguard for the seats and gateways it covers, for as long as it is paid for. It is not exclusive, not transferable, and does not include a right to resell the software or to remove its notices.
Your account
You are responsible for who you admit to your organisation and for what they do with the access you give them. Keep credentials and licence keys to the people entitled to hold them; tell us promptly if you believe either has been taken.
Acceptable use
The product may not be used to break the law, to attack infrastructure you are not authorised to test, to intercept people who have not been told their employer intercepts, or to conceal activity of that kind. Interception in particular carries obligations in most jurisdictions, and meeting them is yours.
What we owe you
We will run the hosted parts with reasonable skill and care, keep the boundary described in our privacy statement, and tell you without undue delay if a breach affects your data. Where a plan states a service level, that statement governs.
Suspension
We may suspend an account that is unpaid, that is being used in the ways listed above, or that is causing harm to the platform or other customers. Where circumstances allow, we will say so first and give you the chance to put it right.
Ending it
You may stop at the end of a paid term. On termination your access ends and your data is removed on the schedule in the privacy statement; export what you need before then, which you can do yourself from the console at any time.
Warranties, liability and changes
No security product makes an organisation safe on its own, and we do not claim Fowlguard does. Except where a plan says otherwise, the software is supplied as it is, without warranties that it will be uninterrupted or that it will detect every threat. Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
Subject to that, neither side is liable for indirect or consequential loss, and our aggregate liability is limited to the fees paid in the twelve months before the claim.
We may change these terms as the product changes. Material changes will be notified to account administrators before they take effect, and the date at the top of this page always says when it was last revised. Questions: legal@fowlguard.com.
